Winter support scheme    22 - 10 - 2020

Rishi Sunak, the Chancellor has just announced changes to the financial support available for businesses through the winter support schemes from 01 November 2020.  In Brief. Job Support Scheme   The business contributions will be reduced and the Government contributions increased. The employee will now need to be working for at least 20% of their usual hours (previously 33%). The employer will now pay 5% of usual hours not worked (previously 33%). The Government will pay 61.67% of the usual hours not worked (previously 33%).     SEISS   Grants for the self employed have been doubled to 40% of previous earnings, with a maximum grant of £3,750 per month for the first grant period (November 2020 – January 2021).   Grants   Business grants are being expanded, particularly for the worst-affected sectors (hospitality, accommodation and leisure). Clients should also keep an eye on their local authority websites as it will be up to Local Authorities to distribute grant funding in their areas.    Read More...

Guidance Note   Sole Directors and the Coronavirus Job Retention Scheme   Please be aware that this note is based on the information published as at 31 March 2020 and is intended to provide guidance on how Foremans LLP believe at this juncture the scheme will be implemented. The below is based on Foremans LLP’s interpretation of the available information. You should not regard this as advice on how the scheme will operate as several factors have still to be announced.   The UK has over one million sole director/shareholder owner managed limited companies including Personal Service Companies. These directors do not qualify as self employed even though they will complete an income tax self assessment tax return. As Directors, if the company has a PAYE scheme and they receive a salary then the Director will be classified as an employee.   We have compiled some frequently asked questions which may help to explain our understanding of the scheme:   Can I claim under The Self Employment Income Support Scheme (SEISS)?   No. The Self Employment Income Support Scheme (SEISS) will not apply to the company directors unless you have other sources of self employed income.   Can I claim under The Coronavirus Job Retention Scheme?   Yes. If you are paid a salary through a PAYE scheme through your company you should be able to claim under the Job Retention Scheme as an employee of your company.   What can I claim?   Your company can claim a grant of up to the lower of: ·         80% of your “regular” salary or ·         £2,500   What period will this grant cover?   The claim can be backdated to 01 March 2020 and is currently expected to last for 3 months.   Can I backdate even if I have been working?   No. The grant is only available from the date that you are “furloughed” by your company   How do I Furlough myself?   We currently have no guidance regarding how to do this. We suggest that the company writes to the Director / Employee advising that they are being furloughed and the date that this is active. A copy of this letter should be retained on the company file Please be aware you cannot work during a furlough period. Foremans will be advising clients of any additional requirements as soon as they are announced.   When does my company PAYE scheme need to be operative from?   The company PAYE scheme must have been operative as at 28 February 2020.   At what date do I need to have been on the payroll to claim?   You must be on your company payroll as at 28 February 2020.   Can I claim if I work part-time in the business?   Yes. The grant is available for full time and part time employees.   How do I calculate my “regular” salary?   Your “regular” salary is the higher of: ·         The same month’s earnings from the previous year or ·         The average monthly earnings from the 2019-20 tax year.   What if my salary is paid annually?   Our understanding is that this should be an acceptable salary for the calculation.   What happens if I reduce my hours of work or my salary?   You are not entitled to claim under the Job Retention Scheme if you are still working.   When can my company claim the grant?   The grant will be claimed through a HMRC portal which is not yet available. Foremans will be updating clients as to when access is expected.   Should I continue to pay my salary from my company?   Yes. Salaries must continue to be paid to directors and employees.   Will I need to pay the 20% not funded?   The additional 20% not funded is a matter for employment law as to whether it needs to be paid. We believe it would be up to the employee or director to consider their employment contract and approach their employer regarding payment.   What if there are insufficient funds in the company bank account to pay the salary?   We would recommend processing the salary and leaving the net salary as an amount due to be paid to the director. The amount due will classified as a loan by the Director to the company until funds are available and it is paid.  Should you require funding you may also wish to consider if you are eligible for a Coronavirus Business Interruption Loan (CBIL). Foremans will be issuing a separate guidance for these loans.   Is the Salary subject to PAYE, NI, pension, student loan deductions etc?   Yes. The salary will be processed as normal through the payroll and is subject to all the normal deductions before payment to you as an employee.   Will the grant cover any cost other than salary?   We believe that the Job Retention Scheme will reimburse employers for employers National Insurance and the minimum autoenrollment pension costs. We are awaiting confirmation regarding the additional employment costs.   Will the grant be repayable to the government once the crisis is over?   No. The Job Retention Scheme payment is a grant not a loan.   How will the grant be accounted for in my company’s accounts?   The grant will be treated as income and, therefore, subject to corporation tax. You should not regard this as advice on how the scheme will operate as several factors have still to be announced.   The scheme is intended to provide a grant to self-employed individuals or partnerships worth 80% of their profits per month up to a cap of £2,500 per month. The scheme is available initially for the next 3 months. The intention is to provide similar support to the self-employed as the Job Retention Scheme does for employees.   Eligibility:   To be eligible you must meet all of the criteria below: 1.      Be self-employed or a member of a partnership. Please note we do not believe Company Directors will be treated as self-employed; 2.      Have lost trading/partnership profits due to COVID-19; 3.      File a tax return for 2018/2019 as self-employed or a member of a trading partnership; 4.      Have traded in 2019/2020; 5.      Be currently trading at the point of application (or would be except for COVID-19); 6.      Intend to continue to trade in the tax year 2020/2021; 7.      Have trading profits of less than £50,000; 8.      More than half of your total income comes from self-employment. This can be in reference to at least one of the following conditions: ·         Your trading profits and total income in 2018/2019 ·         Your average trading profits and total income from up to the three years between 2016/2017, 2017/2018 and 2018/2019.   Access   1.      HMRC will be administering the scheme. 2.      Individuals should not contact HMRC now. 3.      HMRC will use existing information, we believe from filed self assessments, to check eligibility and invite applications once the scheme is operational. 4.      Grants will be paid directly to the eligible claimants’ bank account. 5.      Grants are expected to be paid out by the beginning of June 2020.   If you are eligible but have not submitted your self assessment tax return for 2018/2019. HMRC have announced that you have 4 weeks from 26 March 2020 to file the return and, therefore, become eligible for the scheme.   Grant Amount   The amount of the grant per month will be the lower of:   ·         80% of the average profits from the tax years 2016/2017, 2017/2018 and 2018/2019; ·         £2,500.   WARNING   The Support Schemes announced by the UK Government are only available directly through HMRC. If you receive any communication including texts, calls or emails from anyone claiming to be HMRC saying that you are due a tax refund or saying that you can claim financial help PLEASE DO NOT click on any links or provide any personal information. Advice Note   Practical Business Advice – Coronavirus 25 March 2020   The Government is continuing to issue advice and guidance for businesses. Whilst there is a lot of speculation in the media we are still awaiting clarification on how some of the measures are to be implemented. Foremans will continue to update our clients as and when information is received from the Government. We have noted below some measures which we believe may affect our clients.     Employers   A Coronavirus Job Retention Scheme has been announced. All UK employers with a PAYE scheme will be able to access support to continue paying some of their employees’ salary whilst they are unable to work during the crisis. The suggested amounts are the lower of 80% of salary and £2,500 per month. The payment will be a grant rather than a loan. We believe the salary will be paid through the normal business payroll under the Real Time Information (RTI) system.     VAT   All VAT registered UK businesses will be eligible to defer any VAT payments due between the 20 March 2020 and the 30 June 2020. VAT payments due to be paid in this period will need to be paid by the end of the 2020/21 tax year. For example - VAT payments due in this period may be as follows:   Quarter End Normal Payment Due Date if paid by bank transfer:   29.02.2020 07.04.2020 Defer 31.03.2020 07.05.2020 Defer 30.04.2020 07.06.2020 Defer   If you pay by Direct Debit we would advise cancelling your direct debit immediately.   VAT refunds and reclaims will be paid by the Government as normal.   VAT returns should still be filed by the due date.     Self Employment   If you are self employed and are due to make a self assessment payment on account on 31 July 2020 you can defer making the payment until 31 January 2021. We are not yet aware if this will need to be applied for or if it will be automatically applied.       Time to Pay   HMRC have also upgraded their time to pay service for businesses. Late payment legislation    28 - 02 - 2020

New legislation tackling late payments (courtesy of trusttheguild.com) A substantial step forward in solving the perennial problem of late payments is currently awaiting discussion in the House of Lords. A private member’s bill - demanding a 30-day limit on settling invoices - has received a first reading, following its introduction to the House by Labour Peer Lord Mendelsohn on 21st January. a date for a general Lords debate on the bill had not been scheduled. The core of the proposed new law is a statutory limit of 30 days for settling all invoices. There will also be a blanket ban on the practice of expecting suppliers to be out of pocket in return for prompt payment. The bill also outlaws the system of large construction contractors charging fees to smaller firms to be included on preferred supplier lists.   Read More...



HMRC Warning    12 - 02 - 2020

HM Revenue and Customs (HMRC) is warning millions of Self Assessment customers to be aware of fraudsters now the deadline has passed. Over the last year, HMRC received nearly 900,000 reports from the public about suspicious HMRC contact - phone calls, texts or emails. Some of the most common techniques fraudsters use include phoning taxpayers advising of a fake tax refund, or pretending to be HMRC by texting or emailing a link which will take customers to a false page, where their bank details and money will be stolen. Fraudsters are also known to threaten victims with arrest or imprisonment if a bogus tax bill is not paid immediately. HMRC operates a dedicated Customer Protection team to identify and close down scams but is advising customers to recognise the signs to avoid becoming victims themselves. Customers are urged to take action by forwarding details of suspicious calls or emails claiming to be from HMRC to phishing@hmrc.gov.uk and texts to 60599. Figures released by HM Revenue & Customs show that 11.1 million taxpayers filed their 2018/19 returns ahead of the 31 January 2020 deadline, with over 90% doing so online. Over 700,000 submitting on deadline day and over 26,000 filing in the final hour before the 11.59pm cutoff. But 958,296 taxpayers missed the deadline, and now face an automatic fine of £100. ; ;Warning.  Phishing is Dangerous.  HM Revenue and Customs have issued a warning regarding "phishing" emails being sent by fraudsters following the 31 January 2011 self assessment deadline.

 
The "phishing" email informs the recipient they are due a tax rebate, and provides a click-through link to a replica of the HMRC website. The recipient is asked to provide their credit card details. Fraudsters then try to take money from the account using the details provided. HMRC's New Computer    15 - 09 - 2010

What is HMRC doing? HMRC installed a new computer system in the summer 2009. The aim is to improve the operation of Pay As You Earn (PAYE) by bringing all a taxpayer’s records together and making sure that allowances and tax rates are operated correctly across all employment or pension income sources. The new system is performing automated end of year tax reconciliations. Previously HMRC have undertaken the reconciliation manually. The automated reconciliations are for the tax years 2008/09 and 2009/10.                                                                                                                The reconciliation is between the tax calculated as due from an individual and the income tax actually received from the individual.   • The Limited Company is trading normally i.e it is not subject to IR35 and is not a Managed Service Company

  • The Current tax rates are taken from the Fixed Data Table
  • The current Value Added Tax Rate is 20% and is applied to all invoices and expenses as appropriate
  • The Director's Salary is fixed in relation to National Insurance thresholds. Higher Rate Taxpayers should consider the advantages and disadvantages of a larger annual salary or bonus
  • Higher Rate Taxpayers may wish to consider the advantages and disadvantages of shared ownership of their business
  • Users with a tax code other than three digits and letter "L" may telephone or email our Development Department to request a detailed calculation
  • Generally the use of an Umbrella rather than an Agency payroll is only efficient if sufficient weekly expenses are allowable and claimed
  • The expenses claimed under an Umbrella should not prevent the proper operation of National Minimum Wage
