Prevent Illegal Working

All employers have a duty to prevent illegal working by carrying out document checks on potential employees to ensure they have the right to work in the UK, before employing them.
 


Failure to carry out these checks and then being found to be employing an illegal worker, could result in a £10,000 fine for each illegal worker or a two years prison sentence.
 
HMRC suggest three steps that must be undertaken to avoid a fine:
  • Before employment take copies of original documents showing the holder is allowed to work;
  • The employer should be satisfied that the documents presented are genuine and that the person presenting them is both the rightful holder and allowed to do the type of work;
  • Repeat checks especially If the person employed has a time limit on their stay.
